Criminal defense attorney Shan Wu, white collar crime specialistwas candid in saying that the recent legal presentation by Donald Trump’s lawyers opposing the Department of Justice’s (DOJ) counterargument on the appointment of a special master to review the documents seized at Mar-a-Lago it is an “embarrassment to the legal profession”.
It was through his column for the Daily Beast that Wu indicated that the legal representatives of the former president are overwhelmed and have no idea how to defend their client, conclusion he reached after summarizing his new presentation: “It smacks of extremism and desperation perhaps born of being maneuvered into a legal corner by Attorney General Merrick Garland’s Department of Justice.”
Wu even crossed out “ridiculous” tactics of Trump’s lawyers.
“These are not the usual ways of trying to avoid criminal charges,” Wu argued, adding: The usual way to defend against criminal investigations is for defense attorneys to do their own investigation and try to convince prosecutors that they are barking to the wrong tree.
“Clever Justice Department response trumped Trump’s team by focusing on the fact that a criminal investigation involving the national defense cannot proceed without access to materials implicating the national defense and simply asking that the investigation be allowed to proceed even as the parties quarreled over whether it was need for a special master and the exact scope of what the special master could oversee,” he wrote before adding: “This approach also offers Judge Cannon a compromise for which she still can preserve a victory for Trump in the search for a special teacher for the ostensible purpose of promoting public confidence in the investigation while at the same time reducing the risk of a humiliating and outright reversal on appeal.”
Wu closed his analysis by assuring that Garland, as an appeals judge, can give the Department of Justice a great advantage, due to his more than 20 years of experience.
